Federal Judge Blocks Trump’s Latest Attempt At Ending Birthright Citizenship

A Biden-appointed federal judge blocked President Donald Trump’s latest attempt to end birthright citizenship late Wednesday.

The U.S. District Judge Deborah Boardman cited the U.S. Supreme Court when she issued the injunction for the remainder of a class-action lawsuit being brought against the administration by immigrant families and advocacy groups, the Associated Press reported. “The Supreme Court has spoken: Children in the certified class are ‘citizens at birth,’” Boardman wrote in her ruling, referring to the court’s late June 6-3 ruling that ended Trump’s first attempt at ending birthright citizenship.

But that didn’t deter Trump for long, as an August 6 executive order was signed with the goal of effectively ending birthright citizenship for the children of illegal aliens, foreign employees, foreign surrogates, and those born during commercial or diplomatic visits to the U.S.

“This Court must, once again, preliminarily enjoin enforcement of the President’s most recent attempt to strip the right to citizenship from them,” Boardman , calling Trump’s second attempt at ending birthright citizenship, “unprecedented.”

“The President has tried, through Executive Order, to upend our country’s longstanding tradition of birthright citizenship and eliminate, for large swaths of Americans, the right to citizenship by birth, a right enshrined in the Citizenship Clause of the Fourteenth Amendment.”

Attorney General Todd Blanche told Fox News Wednesday night that the administration was not surprised by the decision, despite the administration’s intention to protect American citizens and to refer to the Constitution’s framers’ view on citizenship.

However, Blanche said the newest Executive Order was crafted around, and in accordance with, the Supreme Court’s order, noting that “If we have to go back to the Supreme Court, we will.”

The Secretary of the Department of Homeland Security, Markwayne Mullin, also spoke out against the order on Fox News, saying that birthright citizenship has become “a cash cow for illegal activity ” with the rise of birth tourism, in which parties come to the U.S. with the explicit goal of having their child there.

“We have activist judges that are going after everything [President Trump] is trying to do while they turned a blind eye to the actual corruption and the destruction of America underneath the Biden Administration.”

Several Republicans in Congress are also pursuing options to legally end birthright citizenship through legislative means.
