DA Will Not Seek Death Penalty In Nick Reiner’s Murder Trial

“In deciding whether or not the DA’s office was going to seek the death penalty, we have gone through a rigorous review where we look at the aggravating factors as well as the mitigating factors, where we have spoken to the victims’ family, we have spoken to prosecutors, law enforcement, and worked with the most senior people in the district attorney’s office,” Hochman said Tuesday, according to CNN.

Reiner faces two counts of first-degree murder in the killings of his parents, Michele and Rob Reiner, alongside an added allegation of lying in wait, according to an unsealed last month.

Sources with knowledge of the situation told TMZ that Hochman and his team decided not to pursue the death penalty for several reasons, one of which was directly correlated to the views held by his late parents.

Rob and Michele were against the death penalty and had voiced support for Erika Kirk when she forgave Tyler Robinson, the man who allegedly killed her husband, Charlie Kirk, according to TMZ. (RELATED: ‘My Living Nightmare’: Rob Reiner’s Son Breaks Silence After Tragic Double-Murder)

TMZ reported that Hochman also considered the impact on Nick’s siblings, Romy and Jake Reiner, who could face the painful prospect of entering the sentencing phase with the possibility of their brother’s execution hanging over them.

Nick may still face a life sentence without the possibility of parole.

Rob and Michele were murdered in their home Dec. 14, 2025.

Reiner, who turned 33 Monday, has pleaded not guilty.
