Gabiev entered the U.S. in 2022 and was reportedly released by former President Joe Biden\u2019s administration, according to the New York Post.<\/p>\n<p>Gabiev, who was 32 years old at the time of the March 2024 incident, was charged with criminal vehicular homicide and reckless driving as a result of the crash that killed Timmy J. Tarnowski, according to the Minnesota Star Tribune. Tarnowski was driving east on the highway and pulling two trailers when Gabiev failed to stop his vehicle while driving north and collided with the truck.<\/p>\n<p>A state trooper responded to the scene of the collision after 5 p.m. on March 5, 2024, and found the trailer lying on its side and engulfed in flames. Medics also responded to the scene, where they pronounced Tarnowski dead.<\/p>\n<p> <!-- \/10519169\/dailycaller_incontent_2 --> <\/p>\n<p>When the trooper approached Gabiev\u2019s vehicle, he noticed an iPad still playing a YouTube video inside the vehicle. Gabiev said \u201che was listening to a program on an iPad that was teaching him how to speak English\u201d and \u201che claimed to not have been looking at the iPad when he was driving,\u201d according to the charges, the Minnesota Star Tribune reported. <strong>(RELATED: Suspect Allegedly Strikes ICE Agent With Car While Fleeing Arrest)<\/strong><\/p>\n<p>Gabiev was sentenced to six months in prison after pleading guilty to the criminal vehicular homicide charge, but a judge spared his sentence, the Minnesota Star Tribune reported in July 2024. Gabiev faced 69 days in jail, as a result of having credit for time already served, and three years of probation. In addition, he was ordered to take a safe driving course and pay $5,437 to Tarnowski\u2019s family.
