One of the largest state college systems in the United States is being sued for harassment policies that punish students for \u201cmisgendering\u201d or making jokes about the gender identity of classmates.<\/p>\n

Defending Education (DE) sued the University of California (UC) Thursday for its \u201cunconstitutional speech policies\u201d governing its code of conduct for sexual harassment. DE alleged that the university\u2019s Sexual Violence and Sexual Harassment (SVSH) policy violates the First and Fourteenth Amendments. UC\u2019s mandatory \u201cSexual Harassment, Anti-Discrimination, Prevention and Education\u201d (SHAPE) training is required of all employees and students to maintain a \u201ccommunity free of sexual harassment, sexual violence, retaliation, and other behavior,\u201d the policy manual notes.<\/p>\n

Behavior deemed \u201charassment\u201d by the university can include \u201cmisgendering\u201d someone or even making jokes about the gender identity of a classmate or coworker.<\/p>\n

The policy defines sexual harassment as \u201csex-based conduct that creates a hostile environment.\u201d Harassment can take shape in \u201cacts of verbal, nonverbal, or physical aggression, intimidation, or hostility based on gender, gender identity, gender expression, sex- or gender-stereotyping, or sexual orientation.\u201d<\/p>\n

<\/p>\n

\u201cThese categories also would be interpreted to include conduct based on sex characteristics, [\u2026] trans identities, and those who identify as intersex,\u201d the policy adds.<\/p>\n

The \u201cintentional or repeated use of a name or pronoun inconsistent with the individual\u2019s gender identity\u201d is listed as a form of harassment. A student who uses a trans-identifying man\u2019s \u201cdead-name\u201d \u2014 the \u201cname that a transgender person was given at birth but that they no longer use\u201d \u2014 is liable for punishment from the university, according to the policy manual.<\/p>\n

The policy also lists the use of jokes about a person\u2019s sexual orientation as a form of harassment: students who \u201claugh at a student for \u2018acting gay’\u201d are liable for punishment, the manual says.<\/p>\n

<\/p>\n

\u201cProhibited conduct\u201d is not limited to situations on campus alone, but can occur \u201coff University property and outside the context of a University program or activity\u201d in any conduct the college deems has \u201cadverse effects\u201d on campus environment.<\/p>\n

The policy is enforced by the university\u2019s \u201cSystemwide Title IX Director,\u201d who must \u201cinterpret this Policy consistently and in a way that does not substantively change the Policy.\u201d<\/p>\n

The university candidly admits in the policy that it \u201cwould prefer\u201d not to implement many of the pre-Biden-era Title IX regulations that were reimplemented by President Donald Trump\u2019s administration in 2025. The Trump administration regulations rest on the \u201cbasis of biological sex.\u201d (RELATED: Democrats Put On Masterclass In Missing The Point During Child Sex Change Hearing)<\/strong><\/p>\n

The policy states the university abides by the Title IX regulations \u201conly when required\u201d for fear of receiving federal funding cuts.<\/p>\n

The filed lawsuit objects to UC\u2019s efforts to \u201ccoerce\u201d students\u2019 speech on matters of public concern. \u201cUnder the guise of \u2018sexual harassment,\u2019 UC has enacted a speech code that punishes students for engaging in protected speech and discourages them from expressing views outside of the university-approved mainstream,\u201d the lawsuit writes.<\/p>\n

Neither the University of California nor its Systemwide Title IX Director responded immediately to the Daily Caller\u2019s requests for comment.<\/p>\n
