Seventeen Republican attorneys general filed a federal lawsuit Monday challenging a California environmental law they argue impacts the entire country.<\/p>\n

The lawsuit, led by Republican Nebraska Attorney General Mike Hilgers, is challenging California\u2019s Plastic Pollution Prevention and Packaging Producer Responsibility Act, to the suit. The law \u2014 which Democratic Gov. Gavin Newsom signed in 2022 \u2014 imposes extensive requirements for companies, manufacturers and distributors that package or ship products to California.<\/p>\n

\u201cThe act offends state sovereignty,\u201d the lawsuit claims. \u201cCalifornia is not entitled to pronounce nationwide policies; it has no power to \u2018project its legislation\u2019 into other States as if it were among equals.\u201d<\/p>\n

A Monday \u00a0from Hilgers\u2019 office claims that the legislation forces \u201cbusinesses across the country to comply with California\u2019s contrived environmental preferences\u201d and impacts \u201cvirtually every business that uses plastic packaging.\u201d<\/p>\n

\u201cThe Plastics Act\u2019s onerous requirements are expected to drive up prices on everyday goods, disproportionately affecting low-income and vulnerable populations,\u201d the release adds.<\/p>\n

<\/p>\n

The states joining Alabama in the suit against the California Department of Resources and Recycling and Recovery (CalRecycle) include Alabama, Florida, Georgia, Idaho, Indiana, Iowa, Louisiana, Missouri, Montana, North Dakota, Oklahoma, South Carolina, South Dakota, Texas, Utah and West Virginia. All of the states have Republican attorneys general.<\/p>\n

CalRecycle told the Daily Caller News Foundation that it does \u201cnot comment on pending or potential litigation\u201d and \u201cremains focused\u201d on implementing the law and \u201cadvancing requirements established in statute.\u201d<\/p>\n

When asked for comment, Hilgers\u2019 office referred the DCNF to its press release.<\/p>\n

<\/p>\n

\u201cOnce again, California is trying to enact a policy that negatively impacts the rest of the country. If California goes unchecked, consumers will be forced to pay more for basic necessities,\u201d Hilgers said in the release. \u201cNo state should limit interstate commerce, let alone delegate the power to set and collect taxes to a third party outside of the scope of the public scrutiny,\u201d Eric Hoplin, President and CEO of National Association of Wholesale-Distributors (NAW), said in the company\u2019s Monday press release. NAW is the only business plaintiff in the case.<\/p>\n

\u201cBecause the act extends California\u2019s regulatory reach far beyond its borders and brings within its sweep conduct wholly unconnected to California, the Act violates principles of federalism, the horizontal separation of powers, and due process,\u201d Hoplin added, according to the press release.<\/p>\n

California\u2019s law also requires businesses to register and pay fees for the Circular Action Alliance (CAA), according to NAW\u2019s press release. CAA is a non-profit dedicated to implementing Extended Producer Responsibility laws on paper and packaging, according to its website.<\/p>\n

The alliance is allowed to collect fees of up to $500 million for business seeking access to California\u2019s market, the press release from Hilgers\u2019 office noted.<\/p>\n
