Jackson authored a scathing rebuke of Supreme Court Justice Clarence Thomas\u2019 dissenting opinion, using the phrase \u201cunderstood the assignment,\u201d which is commonly referenced on social media by Gen Z and TikTok users. Jackson was\u00a0siding\u00a0with the court\u2019s 6-3 decision to uphold birthright citizenship, which automatically grants individuals born on American soil United States citizenship.\u00a0(RELATED: Supreme Court Shoots Down Trump\u2019s Birthright Citizenship Order)<\/strong><\/p>\n

\u201cIn the aftermath of the Civil War, those who championed the Fourteenth Amendment \u2014 both within and beyond Congress \u2014 understood the assignment,\u201d Jackson . \u201cTheir work product used \u2018language that transcended race and region,\u2019 and thereby \u2018changed and broadened the meaning of freedom for all Americans.’\u201d<\/p>\n

\u201cInstead of the limited salve the principal dissent makes it out to be, the Citizenship Clause reflects this universalist approach.\u201d<\/p>\n

Jackson, who was nominated by former President Joe Biden, ultimately sided with Supreme Court Justices John Roberts, Sonia Sotomayor, Elena Kagan, and Amy Coney Barrett.<\/p>\n

Jackson has used unorthodox phrases to add personality to her Supreme Court opinions before. During the 2025 term, Jackson authored the dissenting opinion in the Trump v. CASA case, which the Court ruled, 6-3, cannot allow lower courts to issue universal or nationwide injunctions. The lawsuit\u00a0was in response\u00a0to President Donald Trump\u2019s January 2025\u00a0executive order 14160,\u00a0aimed\u00a0at ending\u00a0birthright citizenship for children of illegal immigrants. Lower courts hamstrung the order by issuing nationwide injunctions that blocked it. The Supreme Court later took up the case, where the majority ruled in favor of Trump with Jackson dissenting.<\/p>\n

In her opinion, Jackson tried a Gen Z rhetorical flourish to argue that the executive, not the district courts, was guilty of government overreach.<\/p>\n

\u201cAs I understand the concern, in this clash over the respective powers of two coordinate branches of Government, the majority sees a power grab \u2014 but not by a presumably lawless Executive choosing to act in a manner that flouts the plain text of the Constitution,\u201d Jackson . \u201cInstead, to the majority, the power-hungry actors are\u2026 (wait for it)\u2026 the district courts.\u201d<\/p>\n
