United States. Hemani, the Supreme Court recently explained that the federal drug-related \u2018unlawful users\u2019 prohibition, 18 U.S.C. \u00a7 922(g)(3), was unconstitutional as applied to that defendant who, like Plaintiff Craig Philips here, used marijuana at some point,\u201d the complaint says.<\/p>\n<p>According to the complaint, Phillips was convicted of a \u201cminor misdemeanor\u201d involving marijuana possession in 1994 but maintained a clean record and passed federal and state background checks to purchase firearms on multiple occasions.<\/p>\n<p><!-- \/10519169\/dailycaller_incontent_2 --> <\/p>\n<p>\u201cIn Hemani, the federal government attempted to demonstrate a historical tradition of disarming unlawful drug users by pointing to \u2018habitual drunkard\u2019 laws,\u2019\u201d GOA and GOF\u2019s complaint continues. \u201cHowever, the Court distinguished those \u2018habitual drunkard laws\u2019 on the basis that they did not target \u2018those who simply drank regularly,\u2019 because if they did, \u2018many notable early Americans could have faced trouble.\u2019\u201d<\/p>\n<p>Read more <a href=\"https:\/\/hometransferguide.com\/?p=3108\">EXCLUSIVE: Talarico Finds His Base \u2014 Drag Show Attendees, Mexico Fans And Purged Voters<\/a><\/p>\n<p>GOA and GOF also noted that Phillips was charged with an offense that carried less jail time and a lower fine than some summary offenses that wouldn\u2019t impact his ability to acquire a License to Carry Firearms (LTCF). GOA and GOF referenced the Hemani decision, in which the Supreme Court tossed a conviction under 18 USC 922(g)(3) on Second Amendment grounds.<\/p>\n<p>\u201cBecause there was no evidence that Hemani\u2019s usage of marijuana \u2018ever made him a danger to himself or others,\u2019 the Court held Hemani\u2019s prosecution for firearm possession unconstitutional,\u201d the complaint states.<\/p>\n<p><!-- \/10519169\/dailycaller_incontent_3 --> <\/p>\n<p>Democratic Pennsylvania Gov.
