County Commissioners of Boulder County, a pending landmark case regarding climate liability. <strong>(RELATED: Ketanji Brown Jackson Uses Gen Z Slang In Birthright Citizenship Opinion)<\/strong> Kagan wrote the foreword to the Fourth Edition of the Reference Manual on Scientific Evidence published in 2025 in which she expressed views on climate change.<\/p>\n<p>The foreword should have required her to disqualify herself, the letter alleges, JCN argued, citing federal law.<\/p>\n<p>\u201cJustice Kagan\u2019s conflicts of interest on climate litigation preclude her from serving as the \u2018neutral arbiter\u2019 required by her oath,\u201d Carrie Severino, President of the JCN told The Daily Caller News Foundation in a statement.<\/p>\n<p><!-- \/10519169\/dailycaller_incontent_2 --> <\/p>\n<p>\u201cBy endorsing and penning a promotional preface for a judges\u2019 reference manual featuring an overtly biased \u2018climate science\u2019 chapter, she embraced the partisan ideals and legal theories driving state and local climate lawfare,\u201d Severino added. \u201cThe manual\u2019s bias was so egregious that Congress and state attorneys general called for its removal.\u201d<\/p>\n<p>Read more <a href=\"https:\/\/hometransferguide.com\/?p=3420\">A Kharg Island Invasion Is A Disaster Waiting To Happen<\/a><\/p>\n<p>Those who recuse themselves from a case often do so for two reasons: whether there is a financial interest or there is bias in the judge\u2019s decision, according to Cornell Law School.<\/p>\n<p>\u201cKagan\u2019s implicit judicial endorsement of the manual and her support of climate-lawfare theories are evidence she cannot remain impartial on climate litigation, including the Court\u2019s upcoming Suncor case. She must recuse herself immediately,\u201d Severino\u2019s statement added.<\/p>\n<p><!-- \/10519169\/dailycaller_incontent_3 --> <\/p>\n<p>The JCN president further elaborated her stance on Kagan in a Monday post to X.<\/p>\n<p>\u201cJustice Kagan\u2019s participation in the Suncor case is indefensible given her public endorsement of climate lawfare plaintiffs\u2019 theories,\u201d she wrote. \u201cIf Justice Kagan will not take it upon herself to follow the law, the Senate Judiciary Committee must step in.\u201d<\/p>\n<p>Kagan, a former colleague of Obama at University of Chicago Law School was not a judge prior to her nomination \u2014 unlike the other eight other justices on the Court.
