The Reproductive Freedom and Privacy Act (), set for a vote as a ballot initiative in the November general election, promises to transform Idaho from one of the nation\u2019s strictest pro-life states into something resembling California. <\/p>\n<p>The approved short ballot title states: \u201cMeasure establishing a right to abortion up to fetus viability and to make reproductive decisions regarding one\u2019s own body.\u201d<\/p>\n<p>The ballot\u2019s cloaked language mirrors the successful 2023 Ohio Issue 1 playbook, but carries even greater risks. Activists are attempting to bypass legislatures by employing vague yet sweeping constitutional language that invites expansive judicial interpretation and imports the full suite of California-style policies on abortion and so-called transgender care for minors.<\/p>\n<p><\/p>\n<p><!-- \/10519169\/dailycaller_incontent_2 --> <\/p>\n<p>Idaho has some of the most pro-life laws among the fifty states. Following the U.S. Supreme Court\u2019s decision to overturn <em>Roe v. Wade<\/em>, Idaho activated its trigger law, prohibiting abortion at all stages of pregnancy, with narrow exceptions only for the life of the mother or in cases of rape or incest. The state also maintains a fetal heartbeat law, which prohibits abortions after the detection of a baby\u2019s heartbeat and includes civil liability provisions allowing certain family members an avenue to sue abortion providers. <\/p>\n<p>A court ruling in <em>Adkins v. Idaho<\/em> further  the state\u2019s life exception in 2025 to permit abortions when pregnancy complications create a \u201cnon-negligible risk of dying sooner,\u201d even if death is not imminent. However, mental health conditions alone do not qualify, nor do fatal fetal diagnoses unless they pose a life-threatening risk to the mother. If passed, the RFPA would fundamentally upend Idaho\u2019s current pro-life laws. As a statutory initiative, it would add provisions to the Idaho Code that would effectively decriminalize abortion up to viability for any reason and expand exceptions afterward far beyond current law. Abortions would expand dramatically. Providers would gain liability protections, potentially attracting new practitioners and reversing the exodus. <\/p>\n<p>California has become a destination state for abortion, with laws facilitating telehealth medication abortion and protecting against interstate restrictions. There are no mandatory waiting periods, ultrasound requirements, or many of the targeted regulations common in pro-life states such as Idaho and Texas.<\/p>\n<p>The alarming issue with the RFPA is that its core language could easily extend beyond abortion to radical gender ideology for minors. It establishes that \u201cEvery person has the right to reproductive freedom and privacy.\u201d This right is defined as the ability to \u201cmake personal decisions about reproductive health care that directly impacts the person\u2019s own body.\u201d It\u2019s this broad language, \u201cmake personal decisions about reproductive health care,\u201d that echoes California\u2019s laws granting bodily autonomy for minors seeking \u201cgender-affirming care,\u201d including hormone replacement therapy and surgical procedures that can sterilize children. <\/p>\n<p>It\u2019s important to keep in mind that the move to enact RFPA is not a grassroots initiative by Idaho residents. Much of its movement is part of a coordinated national campaign to transform pro-life states into far-left playgrounds. Ohio was a tragic example of this. These groups target swing voters by using language focused on individual rights, while the actual details enable radical outcomes like abortion up until birth and children sterilizing themselves through barbaric surgical procedures. <strong>(ROOKE: Visa Loophole Quietly Crushing Young Americans)<\/strong><\/p>\n<p>The stakes could not be higher. Idaho\u2019s current laws reflect a deliberate choice to protect life and children from radical gender ideology.
