Bush \u2014 halting the project\u2019s non-security-related work, the case was taken up by the U.S. Court of Appeals for the District of Columbia Circuit, which hitherto  Leon\u2019s order. Yaakov Roth, the principal deputy assistant attorney general of the Department of Justice\u2019s Civil Division, argued June 5 before a panel of three circuit judges: Barack Obama-appointed Patricia Millett, Joe Biden-appointed Bradley Garcia, and Trump-appointed Neomi Rao. Roth claimed three grounds for a reversal of Leon\u2019s order: a lack of standing and the timeliness of the Dec. 12, 2025  by the plaintiff, the National Trust for Historic Preservation in the United States; that existing funding and oversight of the President\u2019s Park, rather than requiring specific congressional approvals, were sufficient project authorizations; and that even the judiciary could and should not interfere in work \u2014 already well underway \u2014 related to national security upgrades. <strong>(RELATED: \u2018A Brazen Interpretation, Indeed!\u2019: Federal Judge Blocks Construction Of Trump\u2019s Grand White House Ballroom)<\/strong><\/p>\n<p>The Court\u2019s majority, ultimately, did not agree.<\/p>\n<p><iframe allowfullscreen=\"allowfullscreen\" class=\"truthsocial-embed\" src=\"https:\/\/truthsocial.com\/@realDonaldTrump\/117039600038088122\/embed\" style=\"max-width: 100%; border: 0\" width=\"600\"><\/iframe><\/p>\n<p>\u201cWhether or not a massive ballroom should be constructed is for Congress to decide and is not a matter for Executive self-help,\u201d the judges wrote in a 2-1 opinion  Friday.<\/p>\n<p>\u201cThis holding has nothing at all to do with whether the proposed ballroom is desirable, or not, as a matter of policy. This ruling does not even necessarily mean that the Defendants may not ultimately construct the ballroom.\u201d<\/p>\n<p><!-- \/10519169\/dailycaller_incontent_2 --> <\/p>\n<p>\u201cWhat it does mean,\u201d the Court continued, \u201cis that the Defendants may not do so during the district court\u2019s expeditious litigation without securing Congress\u2019s authorization, as the Constitution and laws require.\u201d<\/p>\n<p>\u201cEach President is a temporary tenant, not the owner, of the White House and its Executive Residence,\u201d it also stated. The President has no \u2013 and claims no \u2013 constitutionally assigned authority over that property, which is designed and maintained for the use of all Presidents, current and future, and for the American people.\u201d<\/p>\n<p>The Court noted it would pause its order for two weeks to allow for the administration to appeal to the Supreme Court.<\/p>\n<p><!-- \/10519169\/dailycaller_incontent_3 --> <\/p>\n<p>\u201cTwo Obama and Biden Appellate Court Judges just voted against the desperately needed Military Center, required for the National Security of Washington, D.C., and our Country, itself,\u201d Trump wrote in a Friday post to Truth Social. The president then quoted a selection of the lone dissent opinion by Circuit Judge Rao that \u201c[t]he district court elevated the aesthetic displeasure of a single passerby over the government\u2019s security interests in the ballroom and the security risks of leaving an open construction site at the President\u2019s home and office.\u201d<\/p>\n<p><iframe allowfullscreen=\"allowfullscreen\" class=\"truthsocial-embed\" src=\"https:\/\/truthsocial.com\/@realDonaldTrump\/117055247374455490\/embed\" style=\"max-width: 100%; border: 0\" width=\"600\"><\/iframe><\/p>\n<p><\/p>\n<p>\u201cThe decision has been stayed, and does not take effect for a period of time. We will be immediately appealing to the United States Supreme Court,\u201d Trump continued. \u201cIt is all tied together as one big, expensive, and very complex unit, which is vital for National Security and Military Operations of the United States of America! The Circuit Court\u2019s decision, which is totally wrong on the vital subject of STANDING, of which the plaintiff has none, severely jeopardizes the lives and welfare of the people who work, and will be working, at the White House \u2014 including all future Presidents of the United States, and their families, as well as the lives of all those visiting, such as Heads of State and other Dignitaries, and all Americans who wish to visit the historic, beautiful Executive Mansion. \u2026 This unjust decision must be overturned by the Supreme Court in its entirety. We told them, we said, \u2018You know, you\u2019re being very unpatriotic when you bring a suit like this,\u2019 but it is what it is,\u201d Trump had said during the rescheduled White House Correspondents\u2019 Association Dinner on July 24. \u201cIt\u2019s really going, it\u2019s moving fast. We\u2019re ahead of schedule, we\u2019re right on budget, and it\u2019s gonna be something like I think no country has.\u201d<\/p>\n<p>Leon\u2019s original March 31  to \u201cstop construction of the above-ground ballroom\u201d initially was due to take effect April 14, before the judge clarified its scope and pushed enforcement off until April 23. The appeals court, however, temporarily  his initial order to review safety and separation-of-powers concerns, and then pending any further order by the Court after arguments were heard June 5. As a result, the excavators, pile drivers, concrete pumps, and other construction equipment hitherto essentially churned on without delay \u2014 and reportedly accelerated \u2014 since the East Wing was demolished Oct. 20, 2025, and 238 days after the National Trust\u2019s lawsuit was .<\/p>\n<link\/>\n<p><\/p>\n<p><\/p>\n<link\/>\n<p><\/p>\n<p>Since its July 2025 announcement, the scope of the East Wing\u2019s modernization was revealed to feature bulletproof glass,and both a \u201cdrone-proof,\u201d missile-resistant steel roof and \u201cdroneport\u201d capping the 89,000-square-foot project, including a 22,000-square-foot state ballroom. On the other hand, bomb shelters, secured telecommunication and biological defense systems, and a hospital and other specialized medical facilities are amomg the secret military infrastructure reportedly extending six stories below grade. Likewise, the cost of the $400 million project first pitched as being completely paid for by private donors has risen to $600 million, funded in part with $155 million from the U.S. Secret Service, $149 million from the White House Military Office, and $3 million from the Executive Residence\u2019s accounts, according to The Washington Post.<\/p>\n<p><iframe loading=\"lazy\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; fullscreen; picture-in-picture; web-share\" allowfullscreen=\"\" frameborder=\"0\" height=\"315\" referrerpolicy=\"strict-origin-when-cross-origin\" src=\"https:\/\/www.youtube.com\/embed\/qQxek3C2Gds?si=GwZXOdorn4NZCSf4\" title=\"YouTube video player\" width=\"560\"><\/iframe><\/p>\n<p><\/p>\n<p>Leon\u2019s original order halted the ballroom construction project until Congress authorized its completion but made an exception for \u201cactions strictly necessary to ensure the safety and security of the White House and its grounds \u2026 and provide for the personal safety of the President and his staff\u201d [<em>sic<\/em>]. Trump and his staff subsequently began emphasizing the security need and such features of the project to the media and the judiciary, going so far as to minimize the ballroom as both \u201cinseparable\u201d from and merely capping the secret bunker complex rather than purposed to solve an apparent logistics problem for state functions.<\/p>\n<p>\u201c[T]he underground doesn\u2019t work, isn\u2019t necessary, and would indeed be useless, without the above ground sections. The underground portion is wedded to, and serves, the upper portion,\u201d Trump claimed on Truth Social soon after Leon  his  April 16. \u201cIt\u2019s all tied together as one big, expensive, and very complex unit, which is vital for National Security and Military Operations of the United States of America! [<em>sic<\/em>]\u201d<\/p>\n<p><iframe allowfullscreen=\"allowfullscreen\" class=\"truthsocial-embed\" src=\"https:\/\/truthsocial.com\/@realDonaldTrump\/116416177838768498\/embed\" style=\"max-width: 100%; border: 0\" width=\"600\"><\/iframe><\/p>\n<p><\/p>\n<p>While an April 25 assassination attempt on Trump at the Washington Hilton hotel brought the project back into the national spotlight \u2014 and in subsequent  to the courts \u2014 a Senate Republican-proposed obligation of $1 billion in security funding to complete it ultimately lacked support to move forward.
