The Article III Project (A3P) is jumping in to defend one of President Donald Trump\u2019s former Department of Justice (DOJ) appointees who has been a target of politically motivated lawfare, according to an amicus brief obtained exclusively by the Daily Caller. <\/p>

The brief comes after the D.C. Bar Board on Professional Responsibility recommended disbarring former Assistant Attorney General Jeffrey Clark in 2025 over legal advice he offered surrounding the 2020 election. The board said Clark should be disbarred \u201cas a consequence and to send a message to the rest of the Bar and to the public that this behavior will not be tolerated.\u201d <\/p>

Notably, Clark\u2019s 2020 election memo was internal and not acted upon. <\/p>

The Trump DOJ filed a complaint in response to the D.C. Bar\u2019s actions, alleging the \u201cimproper use of bar discipline to regulate the official actions of Federal Government attorneys,\u201d and citing concerns of government weaponization. A3P echoed concerns that the bar was weaponizing the legal system against Clark for political reasons. (RELATED: DC Bar Recommends Disbarring Trump White House Official)<\/strong><\/p>

\u201cLeftwing Democrat activists are attempting to weaponize state bar rules for a partisan lawfare campaign against Article II officials,\u201d Mike Davis, who founded the organization, told the Caller. \u201cTrying to disbar federal attorneys over internal, pre-decisional legal advice is unconstitutional and an assault on the Supremacy Clause.\u201d<\/p>

A3P filed their amicus brief Wednesday, arguing that attempts to disbar Clark would set a dangerous precedent for \u201cpolitical retribution.\u201d<\/p>

\u201cThe disciplinary proceeding is an attempt to punish a federal attorney for doing his job,\u201d the brief . \u201cAllowing such a transparently political attack on a federal officer sets a dangerous precedent.\u201d<\/p>

\u201cIf Defendants\u2019 theory prevails, political opponents of any administration could file bar complaints against Department of Justice attorneys who take controversial positions,\u201d the brief reads. \u201cThe result would be a federal government staffed by attorneys unwilling to take any position \u2014 even internally \u2014 that might later be characterized as aggressive or politically unpopular. That is precisely the outcome the Supremacy Clause was designed to prevent.\u201d <\/p>
