Texas Children\u2019s Hospital (TCH) in Houston agreed to create the country\u2019s first \u201cDetransition Clinic,\u201d pay $10 million and fire five physicians over its transgender medical program, state and federal leaders\u00a0announced May 15. A three-year investigation by Republican Texas Attorney General Ken Paxton and the Department of Justice (DOJ) made the costs of defending TCH\u2019s secretive, scandal-prone practices outweigh the benefits, in the hospital\u2019s own view. Paxton and the DOJ\u2019s pressure campaign brought unprecedented victories for the transgender movement\u2019s opponents and gives a possible blueprint for them to drive gender ideology out of America\u2019s medical system.<\/p>\n

\u201cWe are fighting and we\u2019re winning and we\u2019re producing results,\u201d former TCH employee Dr. Eithan Haim, who first exposed the hospital\u2019s secret child sex-changes with leaked documents in 2023, told the Daily Caller News Foundation. Haim called the settlement a \u201chead-on-the-spike victory of the conservative movement against a golden calf issue for the radical left.\u201d<\/span><\/p>\n

<\/p>\n

\u201cWe were able to pursue this investigation, this civil process, and make these people pay in a really big way,\u201d the surgeon told the DCNF.\u00a0<\/span><\/p>\n

TCH called the probe \u201cwrought with falsehoods and distractions\u201d in a statement to the DCNF. \u201cTo be clear \u2014 we are settling to protect our resources from endless and costly litigation,\u201d the statement said.<\/p>\n

\u201cWe stand proud knowing we will always put our purpose over politics and that we have and will continue to follow the law,\u201d the hospital said.<\/p>\n

<\/p>\n

\u2018Very Optimistic Signs\u2019<\/h3>\n

TCH\u2019s legal saga began when journalist Chris Rufo published medical records obtained from Haim in May 2023, showing that the hospital secretly transitioned children despite publicly promising to stop. Paxton had already declared such procedures \u201cchild abuse\u201d under state law in a February 2022 . Days later, Paxton that eventually brought about the landmark settlement. Former TCH nurse Vanessa Sivadge went public in 2024 about the hospital allegedly falsifying patients\u2019 records with fake diagnoses in order to bill taxpayers for transgender procedures under Medicaid, which became another focus of the Texas probe.<\/p>\n

The Biden administration\u2019s DOJ investigated and indicted Haim with the Department of Health and Human Services\u2019 backing on charges of violating medical privacy law. However, Republican Texas Gov. Greg Abbott signed a ban\u00a0on child sex changes in 2023 that withstood legal challenges, the hospital announced again that it was ending transgender \u201ccare\u201d that year and the Trump administration dropped Haim\u2019s charges in January 2025 after public outcry.<\/p>\n

Even after those wins, Haim never thought the results of TCH\u2019s legal troubles would be so \u201cmonumental,\u201d he told the DCNF.<\/p>\n

\u201cNever in a million years, dude, would I have ever imagined this outcome,\u201d Haim said. \u201cLike, if a year ago someone told me, I\u2019d be like, \u2018That\u2019s stupid. That\u2019s like a fairy tale.’\u201d<\/p>\n

Paxton kicked off his 2023 probe with a May 2023 \u201cRequest to Examine\u201d that required TCH to hand over records on its transgender medical practices. The request warned that hiding the information would be unlawful and could cost the hospital its right to do business in Texas.<\/p>\n

The attorney general accused TCH of \u201cbilling Texas Medicaid for unallowable and illegal \u2018gender-transition\u2019 interventions, including by using false diagnosis codes,\u201d a May 15 statement from his office says. The DOJ alleged the hospital violated the Federal Food, Drug, and Cosmetic Act regulating medication, the fraud-related False Claims Act and other \u201cfraud and conspiracy laws.\u201d (RELATED: Trump DOJ Moves To Dismiss Biden Admin\u2019s Charges Against Doc Who Exposed Child Sex Change Procedures)<\/strong><\/p>\n

\u201cWe produced over 5 million documents and conducted multiple internal and external investigations,\u201d the hospital told the DCNF. \u201cThese efforts have required significant staff time and financial resources to defend ourselves.\u201d<\/p>\n

TCH still is not out of the woods.\u00a0Paxton\u2019s settlement requires the hospital\u2019s upcoming \u201cDetransition Clinic\u201d to provide free sex-change reversal treatment for its first five years, terminate five doctors involved in sex changes, \u201cimplement a host of compliance and ethics measures\u201d and change its bylaws to punish physicians who perform the procedures going forward, his office said.<\/p>\n

The public will have to watch whether TCH lives up to its agreements, but they represent \u201cvery optimistic signs\u201d about pro-transgender radicals giving up, Haim told the DCNF.<\/p>\n

The DOJ appears to be following a similar legal playbook for other medical institutions. The department announced in July that it sent more than 20 subpoenas to doctors and clinics involved in child sex changes over possible fraud, \u201cfalse statements\u201d and other claims.<\/p>\n

Targeting medical facilities for health care fraud could prove more effective than medical malpractice lawsuits from former patients, according to Haim. Malpractice cases often rely on courts\u2019 interpretations of vague concepts like \u201cstandards of care\u201d rather than hard evidence of fraudulent records, Haim told the DCNF.<\/p>\n

\u201cFor juries, there\u2019s a lot of wiggle room in those cases \u2026 judges could just be like, \u2018No, fuck you, we\u2019re not allowing this evidence in or that,’\u201d Haim said about malpractice suits. Despite Texas and the Trump administration putting TCH through the wringer, the hospital claims to have been exonerated by their probe.<\/p>\n
