Justice Clarence Thomas blasted the U.S. Supreme Court on Tuesday for blocking Florida\u2019s lawsuit against two blue states that gave a commercial drivers license to an immigrant who later caused a deadly crash.<\/p>\n

The Supreme Court declined to hear Florida\u2019s lawsuit against California and Washington over\u00a0undocumented\u00a0truck\u00a0drivers, with both Thomas and Justice Samuel Alito dissenting. Thomas wrote in his\u00a0\u00a0that he doubts the court \u201chas discretion to refuse to hear cases within its exclusive original jurisdiction.\u201d<\/p>\n

\u201cThis Court has exclusive original jurisdiction over [Florida\u2019s]\u00a0suit because it involves one State suing other States,\u201d Thomas wrote. \u201cArticle III establishes that \u2018[i]n all Cases . . . in which a State shall be [a] Party, the supreme Court shall have [original] Jurisdiction.\u2019 \u2026 Congress has made our original jurisdiction \u2018exclusive\u2019 in \u2018all controversies between two or more States,\u2019 meaning that no other court can hear this case.\u201d (RELATED: <\/strong><\/span>Pro-Democrat Unions Sue Over Trump Admin\u2019s Crackdown On Illegal Migrant Truckers)<\/strong><\/p>\n

\u201c\u2018We have no more right to decline the exercise of jurisdiction which is given, than to usurp that which is not given,’\u201d according to Thomas\u2019 dissent. \u201c\u2018If this Court does not exercise jurisdiction over a controversy between two States, then the complaining State has no [judicial] forum in which to seek relief.’\u201d<\/p>\n

Thomas also asserted in his dissent that \u201cthe only [statute] addressing this Court\u2019s jurisdiction over these kinds of\u00a0cases nowhere contemplates a process of discretionary review,\u201d adding \u201cnonetheless, this Court has adopted a discretionary approach to its exclusive original [jurisdiction] based on \u2018policy judgments that are in conflict with the policy choices that Congress made in the statutory text specifying the Court\u2019s original jurisdiction.’\u201d<\/p>\n

Florida\u2019s lawsuit comes after three people died in an Aug. 12, 2025 crash on the Florida Turnpike after an undocumented truck driver, Harjinder\u00a0Singh, made an illegal U-turn, The Miami Herald\u00a0reported.<\/p>\n

\u201cLaw enforcement soon discovered that Singh, an Indian who had crossed the Mexican border illegally, likely could not read the road signs,\u201d Thomas wrote further. \u201cAfter the crash, the Federal Motor Carrier Safety Administration tested Singh\u2019s English [proficiency]: It found that Singh could not correctly answer most of its verbal questions and that he could identify only one out of four highway signs.\u201d<\/p>\n

\u201cAn illegal alien who cannot read English road signs cannot drive an 80,000-pound tractor-trailer,\u201d Thomas continued.<\/p>\n

Thomas also said that \u201ccrashes like Singh\u2019s are disturbingly common.\u201d<\/p>\n

The Trump administration moved in September 2025 to\u00a0tighten\u00a0eligibility requirements for commercial driver\u2019s licenses following a series of fatal crashes involving foreign truck drivers. In February, the administration also introduced new regulations aiming to prevent unqualified foreigners from driving commercial vehicles, the Daily Caller News Foundation first\u00a0reported.<\/p>\n

Republican Indiana Sen. Jim Banks wrote in a Feb. 27 X\u00a0post\u00a0that \u201cAmerican truck drivers are being ripped off by shady carriers hiring illegal immigrants to drive down wages.\u201d<\/p>\n
